Terms of Service

These terms set out the basis on which Roof Space Australia sells rooftop tents, annexes and accessories through www.roofspace.com.au. Please read them before you order.

1. About us and these terms

This website is operated by [LEGAL ENTITY NAME] (ABN [ABN]), trading as Roof Space Australia (“Roof Space”, “we”, “us”, “our”). Throughout the site, the terms “you” and “your” refer to you, the user or customer.

By visiting our site, browsing our products or placing an order, you agree to be bound by these Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and Warranty Policy, each of which is incorporated into these terms by reference.

If you do not agree to these terms, please do not use the site or place an order.

2. Eligibility to purchase

To place an order you must be at least 18 years of age and have the legal capacity to enter into a binding contract. By ordering you confirm that you meet these requirements and that the information you provide is accurate and complete.

You may not use our products for any unlawful purpose, nor may you breach any law of the Commonwealth of Australia or of your State or Territory in using our site.

3. Products, descriptions and images

• We take care to describe our products accurately, including weights, dimensions, capacities and compatibility information. Specifications are provided in good faith and may be updated as products are improved.
• Product photography, video and 3D renders are illustrative. Colours can vary between screens, and accessories shown in imagery are not included unless expressly listed in the product description.
• Roof load, vehicle compatibility and roof-rack requirements vary by vehicle. Any compatibility guidance we provide is a guide only. You are responsible for confirming your vehicle’s dynamic and static roof-load ratings with your vehicle manufacturer and for ensuring your roof rack or crossbars are rated for the load.
• We reserve the right to modify, discontinue or limit the quantity of any product at any time without notice.

4. Pricing

• All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
• Prices exclude delivery unless expressly stated. Delivery is calculated and shown at checkout — see our Shipping Policy.
• We reserve the right to change prices at any time before your order is accepted. Price changes do not affect orders we have already accepted.
• Promotional pricing, bundles and discount codes apply only for the period stated, cannot be applied retrospectively, and cannot be combined unless we say so.

Despite our best efforts, a small number of items on the site may be mispriced or contain a typographical error. If we discover an error in the price of an item you have ordered, we will contact you as soon as possible to give you the option of confirming the order at the corrected price or cancelling it for a full refund. If we cannot reach you, we will treat the order as cancelled and refund you in full.

5. Orders and acceptance

Your order is an offer to buy. A confirmation email is an acknowledgement that we have received your order — it is not acceptance of it. A binding contract is formed only when we dispatch the goods or otherwise confirm in writing that we accept your order.

We may refuse or cancel any order at our discretion, including where the product is unavailable, where there has been a pricing or description error, or where we suspect the order is fraudulent or placed by a reseller without our authorisation. If we cancel an accepted order, we will refund you in full.

We may limit or prohibit orders that appear to be placed by dealers, resellers or distributors who are not authorised Roof Space partners.

6. Payment

We accept the payment methods displayed at checkout. Payments are processed by third-party payment providers — we do not store your full card details. You warrant that you are authorised to use the payment method you supply and that there are sufficient funds to cover the transaction.

Where a “buy now, pay later” or instalment provider is offered at checkout, that arrangement is a separate contract between you and that provider, on their terms. We are not a party to it.

Title in the goods passes to you when we receive payment in full.

7. Delivery, risk and inspection

Delivery timeframes, rates and freight arrangements are set out in our Shipping Policy. Rooftop tents are bulky, heavy items and are shipped by specialist freight carriers.

Risk of loss or damage passes to you on delivery, or on collection where you have chosen local pickup. You must inspect the goods on arrival and report any visible transit damage to us within 48 hours of delivery, with photographs, so that we can lodge a claim with the carrier. This does not limit your rights under the Australian Consumer Law.

8. Installation and safe use

Rooftop tents are load-bearing equipment mounted above a moving vehicle. You are responsible for:

• Installing the product in accordance with the supplied instructions, or having it installed by a competent professional or authorised dealer.
• Checking that all mounting hardware is correctly torqued and remains secure before every trip.
• Observing your vehicle’s dynamic roof-load rating while driving and its static roof-load capacity while the tent is occupied.
• Complying with all road rules regarding vehicle height, load restraint and dimensions.
• Never occupying the tent while the vehicle is in motion, and never exceeding the stated occupancy or weight limits of the tent.

To the extent permitted by law, we are not liable for loss or damage arising from incorrect installation, misuse, modification, overloading, or use of the product contrary to the instructions.

9. Warranty

Our products come with a manufacturer’s warranty in addition to the guarantees you have under the Australian Consumer Law. Full details, including what is and is not covered, are set out in our Warranty Policy.

10. Returns and refunds

Our Refund Policy explains when goods can be returned and how refunds are handled. It forms part of these terms.

11. Intellectual property

All content on this site — including text, graphics, logos, product imagery, video, technical drawings, the Roof Space name and marks, and the site’s design — is owned by or licensed to us and is protected by Australian and international intellectual property laws.

You may view and print pages for your own personal, non-commercial use. You may not reproduce, republish, distribute, adapt or use our content or marks for any commercial purpose without our prior written permission. Authorised dealers may use approved brand assets in line with the terms of their dealer agreement.

12. User submissions and reviews

If you send us product reviews, photographs, ideas, suggestions or other material, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt and publish that material in connection with our business, without payment or attribution. You confirm the material is your own, is accurate, and does not infringe anyone else’s rights or contain unlawful, defamatory or offensive content.

We may edit or remove any user content at our discretion, but we are under no obligation to monitor it.

13. Third-party links and services

The site may link to third-party websites, apps or services, including payment providers, freight carriers, review platforms and dealer sites. We do not control those third parties and are not responsible for their content, products or practices. Any dealing you have with them is at your own risk and on their terms.

14. Accuracy and availability of the site

We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that information on it is always current. We may change site content at any time without notice, and we are under no obligation to update it.

We may suspend, withdraw or restrict all or part of the site for business or operational reasons.

15. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded.

Where we are permitted to limit our liability, our liability for a failure to comply with a consumer guarantee in respect of goods is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so. For services, it is limited to resupplying the services or paying the cost of resupply.

Subject to the above, and to the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profits, loss of use, or loss of enjoyment of a trip, however arising.

16. Indemnity

You agree to indemnify us and our officers, employees and agents against any claim or demand, including reasonable legal costs, made by a third party arising from your breach of these terms or your unlawful use of our products or the site — except to the extent the claim arises from our own negligence or breach.

17. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

18. Changes to these terms

We may update these terms from time to time. The current version is always the one published on this page, and it applies from the date shown at the top. The terms that apply to your order are those in force when you place it.

19. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

20. General

• If any provision of these terms is found to be unenforceable, it is severed and the remaining provisions continue in force.
• Our failure to enforce a right does not waive that right.
• These terms, together with the policies referred to in them, are the entire agreement between you and us in relation to your use of the site and your purchase.
• We may assign our rights and obligations under these terms to a related entity or purchaser of our business.
